The winner of the quizz will receive a Peak Performance computer bag "america's cup branded". The next 3 will receive one Peak Performance cap each and the next 3 will receive a Peak Performance belt.
Terms and conditions for the America's Cup Internet Quiz (hereinafter : The Quiz)
1. Eligibility:
The Quiz is open to everyone with an internet connection, provided that the Quiz complies with local laws of the country of the Player's residence. The competition is void where prohibited. Entrants in the Quiz are defined hereunder as "Players".
No purchase is necessary to participate in the Quiz and entries per Player are not limited.
Employees and immediate family and persons living in the same household of employees of the CONSORCIO, associated companies of the CONSORCIO, marketing, advertising and promotional agencies providing services to the CONSORCIO are not eligible to take part.
The CONSORCIO reserves the right to refuse entry or to disqualify any Player if that person is, in the CONSORCIO's good faith judgment, not acceptable as a participant.
2. Minimum technical requirements:
The Quiz is functional for users with the following minimum specifications: Pentium 133 or higher with Windows 98/NT/2000/XP, Mac OS 8+, Netscape 7+, MS Explorer 5.5+, Flash Player 6+.
3. How to play:
Entry to the Quiz is made by Players subscribing the internet americascup.com website. For full details of how to play and access the Quiz see the login page of the Quiz on http:www.americascup.com and click on the quiz section.
Players who tamper with the Quiz code or are caught in any form of cheating will be immediately disqualified.
4. Quiz' winners:
Time period.
The first phase of the Quiz will start on 1st February 2010 and will end the 1 March 2010.
Operation.
The quiz is a set of multiple choice questions.
Each question is worth 10, 20 or 30 points
Each player can replay the quiz as many times as he wants during the period to increase his ranking.
The questions come in a random order.
The player with the highest total score win.
Tied Game.
In case of equal standing on the rankings, winners will be choosen by random output
The decision of the CONSORCIO as to the prize of the Quiz is final.
The winner will be deemed to consent to the use of his name, likeness and image for publicity and commercial purposes in all media world-wide (including online) without further compensation.
A list with the winner's name and its prizes may be available on the americascup.com website.
5. Prizes:
The winner will receive some America's Cup® products offered by Peak Performance.
No prize substitution or cash alternative is available and the prizes are not transferable without the CONSORCIO's approval. The CONSORCIO shall have the right to substitute the prize being offered with one of equal or greater value.
Winners are responsible for the payment of all applicable taxes incurred by them related to the receipt of any prize they win in the Quiz.
6. Cancellation:
The CONSORCIO may at its sole discretion and without notice cancel, terminate, modify or suspend the Quiz or these Terms and Conditions prior to the cessation of the Quiz for any reason whatsoever, including, for technical reasons such as computer viruses, bugs, tampering or technical failure.
7. Disclaimer:
The Player assumes all liability for any injury or damages caused or claimed to be caused by his or her participation in the Quiz and/or the acceptance and/or use of any prize, and release The CONSORCIO, its respective affiliates, parents, subsidiaries, advertising and promotions agencies and each of their respective officers, directors and employees form any such liability.
The CONSORCIO does not accept responsibility for (a) lost, late or undelivered entries, inaccurate information related to the submission of entries; (b) any technical, computer, online, telephone, cable, electronic, software, hardware, transmission, connection, Internet, website or other access issue, failure, malfunction or difficulty that might hinder the ability of a Player to enter the Quiz; (c) for any event which may cause the Quiz to be disrupted or corrupted.
8. General:
Entry to the competition is always subject to the laws and regulations of each participant's country of residence whereby the participants shall be deemed to be a resident in the country or state identified in their registration details.
By entering this competition, each Player consents to be contacted by The CONSORCIO in relation to information about the CONSORCIO or the CONSORCIO services or which may be of interest to the public. The Player hereby expressly agrees that the CONSORCIO may use the personal data provided by the Player subject to compliance with the database protection legislation.
9. Intellectual Property Rights:
All copyright and other intellectual property rights for all purposes throughout the world relating to the Quiz and its questions and answers,
to the CONSORCIO, the America's Cup®, its name, logos, in particular to belong exclusively to the CONSORCIO and/or America's Cup Property Inc..
10. Applicable Law and Place of Jurisdiction
By entering the Quiz, the Players agree to be bound by these terms and conditions which shall be governed by the laws of Switzerland. The courts of Geneva, Switzerland shall have exclusive jurisdiction to settle any dispute which may arise in connection with these Terms and Conditions and/or the Quiz. Notwithstanding the foregoing, the CONSORCIO shall have the right to bring any legal proceedings before the competent courts of the country of the Player's residence.
